R.M. COURT.
EKETAHUNA.-FRIDAY, Before Messrs Anderson and Von Reden, J.P.'s, Tumor v Bostier,—This was an aotion brought by the plaintiff to compel • tho defendant, Bosner, to destroy his dog. It appeared that on tho night of the 23rd March two dogs had worried several sheep belonging to plaintiff at Wi Waka, and that he had found 25 sheep worried ind dead, PlaintiS had sent notice to Thompson, tho owner of one of the dogs, who at once paid for tho sheop destroyed and shot his dog. He also sent notice to defendant to destroy his dog, No notice was taken of it, hence the present action. Tho first witness called for.plaintiff, Mr Frederick Bright,"sawmiller, Wi Waka, deposed that on the morning of the 23rd March, about half-past two, ho heard Beveral dogs barking in Tumor's paddock. .Went to sea what was wrong, and found two dogs hailing up about 100 sheep in the corner of the paddock, Drove one away and caught tho other, Could swear one of the dogs was Bosners'. There waß practically no defence. Judgment was given by tho Court that the dog should be destroyed in the presence of' the constable at opce, or- 20s a day be paid for every day the dog lives, defendant also tp pay costs of Court and witnesses expenses amounting to 18s. I bear tho dog was destroyed by Constable Roach the same day,
