DISTRICT COURT

MASTERTON.-TUESDAY, • APRIL 2nd. Before District Judge H. W. Robinson), Bankruptcy Cases. The public examination of Edwin King, of Carterton, was made yesterday. Mr Bunny appeared for the Assignee, Mr Beard for the debtor, and Mr 0, P. Skipper for the creditors. The examination was adjourned, twenty-one days notice to he given before the next sitting of the District Court, of any criminatory charges | that may bo brought against the bankrupt. The Court opened this Tuesday morning with an application 'for the discharge from bankruptcy of Frank Deering Polling and Mary Ann Pelling. Mr Bunny for the Assignee and Mr Pownall for the bankrupt. Mr Bunny stated on behalf of the Official Assignee that the bankrupts had, through their solicitor, Mr Pownall, offered to pay 7s 6d in the £ in their estate, but had failed to do bo, and there was practically no estate,

' Mr Pownall stated that he had intimated by letter to the Assignee that the bankrupts were unable to pay the composition offered. Mr Bunny asked that Mrs Polling should be produced.

Mr Pownall stated that her husband, Mr F, D. Pelling appeared on her behalf, It was impossible for both of them to leave their employment at one time. They were engaged at the Railway Refreshment Rooms, Featherston. He claimed that F. D. Pelling's application for discharge should be heard, as it was a separate estate. If the other side wanted the evidence of Mrs Pelling they should have subpoenaed her. He claimed that tho Court was bound to give his olient his discharge, as there was no opposition to it,' or if there was, he had not received notice thereof.

Mr Bunny said they were uot bound to give notice of the opposition. Bankrupt's counsel could not olaim the right to cross-examine a witness, His Honor said the object of the application was to obtain a discharge and any creditor who wished might examino tho bankrupt. Ho would consent to an adjournment until to-morrow morning to allow of the attendance of Mrs Polling, the two cases were adjournod accordingly. EXAMINATIONS. The examination of William Whitt of Masterton, cabinetmaker, was , declared closed on the application of Mr Board, and he was ordered to come up at tho noxt sitting of the Court for discharge. John Louis Thompson, of Mangamake, contractor. No appearanoo. On the application of Mr Pownall the case was adjournod till next sitting. The Court then adjourned until 10 a.m. on Wednesday.
