Darby i proved'- t-ho case. - Fined sb,' in demult 12 hours m the lookup: same was'.accused;; of -indecent exposure in the/ public street, and pleaded that he had no knowledge of the occurrence. Committed to Weilington gaol for seven days With' hard labour.- ' Robert Gardner was charged with stealing a meerschaum pipe valued at 153; also one bridle belonging to Eason Christian of Wbak'ataki.
Mr Middleton, for the accused, made an objection to tho oatli being taken on account' of the informant not being an Knglishmati, .and probably not of the Christian religion, but the objection was not allowed as the informant said he had had cases before the Supremo Court, and had always taken the oath by kissing the English' Bible. Constable Darby prosecuted. The informant stated that no one but the accused ha'd access to his room. The accused is a blacksmith. Tho pipe, alleged to have been stolen, was produced in Court, andidentiflod, and also the bridle as belonging to the informant, wlio'stated, that lie missed the articles on or about the Bth November last. There were other/articles stolen to the amount of £lO altogether.' ' ' " ■ To Mr Middleton: The room.was a small one, close to the blacksmith's shop., Acoiised stated that' he was going to work there, in consequence of whioh lin was allowed to have the' use of the room. Tho articles in the box had been there for three years, but during the last twelve months there had been no fastening .to the box. The door of the room had been kept locked until accused went there to live. Witness had .been away for about a week, and could not say whether anyone else beside accused had access to the room during his absence. He gave the information of his loss to'the police about the 17th November last. .
Jacob Biemonek deposed' that lie was a stableman and billiard-marker residing at Tinui. He had known the aooused for some time. Saw him about tlio 15th I'ecember "at the Tinui blacksmith's shop, when he offered to sell witness a bridle for 5s fid. He ultimately purchased it for ss, (The bridle produced was identified as being the same). George Osborne, stablekeeper at the' White Hart "Hotel, Carterton, said tlio accused was at tlio stables oh (Saturday last. Acoused had a pipe, which lie mado a present to witness. When Mr Giles asked accused where he had got the pipe, lie said it camo from a Maori. Witness returned the pipe to accused, as it was too strong 'for him. Could not Bay whether the pipe produced was the one or not. , C. H. Giles corroborated the'evidence of tlio last witness, and identified the pipe produced as the" same accused had in his possession on Saturday last, / : "' - Mr Middleton addressed the Court at some length on the evidence adduced. '. 'I he accused had several previous convictions recorded against him, and was committed to gaol for six months on the present charge.
