Would not the inference rather be 1 that Mr Eowlatt did not intend any
tender to be accepted. -Had one of the tenderers made an error and tendered below the architects: estimate would the deposit have been returned or would the deposit have been forfeited if persuasion could not induce the unfortunate one to take up the contract although the contractor knew that it would be a losing one. —I am, ic, '
