Constable Darby v.A. J. Armstrong, for using abusivo language to the plaintiff on Saturday the 16th inst. Mr Middleton for the defendant.
The plaintiff deposed that the abusive language took place at the Lyceum Hall on the date mentioned, when he was in the act of serving a summons on the defendant for an alleged assault. The information was dismissed. • Thomas Swan v. A. J. Armstrong and E. Morrell—charge of assault. Mr Beard for plaintiff, Mr Middleton for Armstrong. Morrell was undefended. The assault consisted of throwing defendant into a ditch on the Carterton Main Road on the 13th inst, and otherwise ill-treating him.
Evidence was given by the complainant, and supported by C. Giles and M. Nicholson.
Evidence was called to prove that the defendant Armstrong had no hand in the assault whatever. The Court held that both of the defendants were concerned in the assault. Armstrong was fined 'los and costs IBs, in default fourteen days imprisonment; Morrell was sentenced to one month's imprisonment, without the option of a fine, Mr Beard, on behalf of complainant, asked the Court if they would be so good as to inflict a line in the case of Swan v. Morrell instead of imprisonment. After due consideration their Worships inflicted a fine of i 5, in default one month's imprisonment. The fine was paid. Mercer and Bayliss v. E. Buckeridge—Dishonored promissary note. Judgment by default, with costs 20s.
Taratahi-Oarterton Eoad Board v. E. H. Kells—Bates £2 10s. Judgment by default for amount claimed, with costs 10s.
John, Elizabeth, and Margarett Mac Gill v. James Lower—Claim for wages £llss, Mr Beard for plaintiff Mr Bunny for defendant, Judgment for £5 and costs 10s.
