Before Mr Von Stunner, K.M.

George Haskell was charged with assaulting Leonard Cook 011 the sth instant. Mr Skipper appeared for plaintiff.^

Plaintiff said lie was a painter and had been working for defendant. About six p.m. on the date in question, lie met defendant outside of Toohill's hotel. They had some words about a stock brush that George Ward had. Defendant called him a double minded b—, and clouted him two or three times with hiiufists on the head. Plaintiff then off to prevent a row. 111 answor to defendant, the plaintiff said be had not gone to defendant's workshop for the purpose of annoying him.

George Ward, called by plaintiff, said the disturbance between Cook and Haskell was about work, Witness asked Haskell if it was true that he bad said that he (witness) had stolen a stock brush. Haskell asked Cook if he had said such a thing to him, and thereupon the assault was committed.

In answer to plaintiff, witness mH Cook said that lie was a better nsu than Haskell in every way, His Worship said the assault was a trifling one, but plaintiff had 110 ■ right to strike a man except in selfdefence. He repeated the blow two or three times. A fine of 5s was inflicted, with cost of witness ss, and solicitor's fee 21s.
