Handyside gaveevidence to the effect that the first notice he saw of the election was orT February 23rd in a copy of the; Daily of thelSthi I ,Had earlier notice, been given, he would have been able to participate in the'eleotion, but as it .happened,.the committee wero.elected ou the day of the nomination, February 21st. His Worship asked for documentary evidence, and Mr F. G. Mooro produced a copy of the Storof the.Uth February which witness stated would reach Tinui on 15th February, Mr Moore raised two objections to the petition, first, the name of Mr J, •F. Maunsell, one of the petitioners, was; not entitled to vote, and 'second that the petition was prepared too late to beentertaiued, as the Act provided that;if; should 1 have been completed within 14 days, whereas it clured until seventeen after the election. He also pointed.out that the Act limits the advertising to ten days before the nominations, consequently it was not possible to give the fourteen clear days notice, as the election came off on the day of the nomination. Mr McHutchon- proved that""tbe election had been carried out according to the Act, and His Worship dismissed the petition with costs L6l6s.
