Barrington, Through a mis.understanding the debtor had not appeared at the sitting of the Court iu the morning, Charles P. Barrington gave evidence that he had inserted the proper notloeß in the Wairarapa papers, alid that he had sent post cards to all the creditors not in the district. A discharge was granted,

The affidavit set forth that the defendant had several times eluded the summons whioh was to have been sewed on him by the biiliff, onoe by running away when it was being handed ;to him,' and auother time, by taking refuge in-bis house. It bad, however, been given to a domestic in his'employ. His Qouor-remarked that there was 'nothing in the affidavit to show that defendant bad knowingly evaded the' summons, because it could not be'shown that he knew it was suoh.
