Mr Board for plaintiff, Mr Sandilands for defendant, The plaintiff stated that he was engaged by defendant sb shepherd at £6O per year, with'the understanding that if he did not like the place he could leave at any time without giving notice, and the defendant could discharge him if ho choße without any previous notice. The defendant being sworn stated that the plaintiff applied.for employment, and he engaged .with him as a shepherd at £6O a year, but nothing was said about his being allowed to leave his employment without first giving notice, for if there had been he would not have employed him. Richard Mahupuka son of defendant, stated that he did not know anything about the terms of the engagement betwoen plaintiff and defendant. Tho plaintiff loft all of a sudden, and gave nn reason for bo doing, Judgment for plaintiff for £3 15s, and casta £ll6s. This concluded tho business,
