T. Parsons v J. Tuok.-Claim for £3, balance for beer supplied. Mr Board for plaintill, Mr Bunny for defendant. This was a case in which tho defendant disputed that the price charged was above the market price. T. Parsons deposed that he supplied the beer in question at tho prico arranged betweon the dofoudant and himself. The prico was £4lss per hogshead, duty paid, a reduction of 5 per cent being allowed for monthly payments. Tho defendant nover had the beer in hoffsheads, but in quarter-casks, three of which inado two hogsheads, A lettor from McCarthy, of Wellington, was received by defendant, offering to supply beer muc/i better than he could obtain locally at £4 per hogshead, and consequently defendant wanted to got his beer cheaper, although bound by his lease to get his supplies from plaintiff. T. Wagg deposed that the amount paid for Staples' beer was £5 Os 3d, including railway freight. Considered Parsons' beer as good as Staples'. Could get their beer where they liked; were not bound to go to one plaoe for their liquor. A, A, Elkins stated that he: had dealt for some considerable time and got all his beer from Parsons'. The usual rate was £4lss per hogshead with 6 per cent for prompt payment, was well satisfied with the article supplied.. . T. Thompson deposed* that he dealt with Mr Parsons at £4l6s per hogshead. Got some occasionally from Mr Staples which cost more money. Drew most of his supplied from Mr Parsons as it was eheiipest. Defendant sworn Btated that he was a

licensed victualler -residing at Eketahuna, he was under arrangment to draw liis i.'supplies of beer from Mr Parsons at current rates. He.was able to get boer from .the largest brewers.'in the province at £4 a hogshead. When he told-.plaintiff that he could get it. cheaper from Wellington, he made a .slight reduction in the account. As plaintiff refused to reduce the price or the beer he declined to pay any more, hence the present action. \Vhen the agreement was signed, Mr Parsons stated the; price.was £4 IBs per hogshead/.' ; •' • '
