Hillier Sutton pleaded guilty to having allowed their chimneys tq qatc]} fp, ancj were each mulcted in a penalty of 5a without coats, A similar charge was mentioned against Edward Ewen, but as he did not appear, a summons was ordered to bo issued against him, TRESPASS. Emma Jeans v Patrick Carr. Mr Beard for the plaintiff and Mr Bunny for the defendant. Mr Beard stated that the plaintiff was the owner of a section of land adjoining the Waipoua, and defendant was a contractor for the Corporation, and had entered the land for the purpose of removing gravel therefrom. He had been repeatedly warned to desist, but he had taken no notice of the warning. Miss Jeans had been in undisputed possession for about 25 years, Miss Jeans deposed that she was the owner of a portion of Section 17 on the plan produced, and had been in possession of it for 28 years, She was here when it was surveyed by Mr Kolleher, who pointed out to her where her boundary was. A lot of the land nearest the river had been washed away, and the peg put in by Mr Kelleher had been washed away with it. The original depth was 1156 links, and there were only 1000 links now. Defendant had carted gravel away from a
piece of her land on which the Borough Council had asked her permission to deposit rubbish. She saw defendant about it, and told him that he must notdo it. One of her posts had been taken down to make a way in. .' (Left sitting).
