MASTERTON.-THIS DAY. Before H. A. Stratford. R.M. CIVIL OASES. \ WairarapaEast County Council v Alfred Eagan Claim for rates, Gsßd, Judgment by default for amount and costs.
Alfredton Road Board v Uwners of sections 161,160,157,163,1-54,86,. 166, and 150, Alfredton ;35,36,37, Mungaonei Fordham-, Bridget, Eaganand the Wellington School Commissioners. In these cases, Mr Macquarie, Clerk of the Board, appeared for plaintiff. None of the defendants attended, and judgment was given for plaintiff for the amount claimed and costs. Mr Macquarrie claimed expenses. •' His Worship said he was afraid that he must treat Mr Macquarrie as a party to the action, and expenses could not therefore be allowed.
Mr Macquarie said that would defeat the local bodies, because they would really incur more expense than the amount they collected. He had to come to Masterton twice on account of these cases,
His Worship regretted that the Courthouse was at such a distance, but could not alter the matter.
W. A. Lyon vA. Vile—Claim £5 and £3 damages, alleged to have sustained through a horse transaction, The facts of the case were that plaintiff bought a horse at auction, which was guaranteed thoroughly staunch and to run in harness, . On thiß statement by defendant he was induced to purchase the horse, having a customer in view, namely Mr Graham, who tried the horse andreturned it as useless. W. Collier and J, Ingley confirmed the statement. The Court was left' Bitting.
