FEATHERSTON.-WEDNESDAY.

Thomas Benton, junr., vM. Brodersen. -Allowing a bull to be at large. Case dismissed on the'ground that the information was laid under an act which had been repealed, and that the alleged offence occurred more than six months previous to the information being laid. A similar case between the same parties was heard, and the information was dismissed, on the ground that the alleged wanderings took place, by permission of the owner of the land. '

Ratima Ropilia, Iliaka Hutana, and David Johnston, were charged on the information of Joseph Judd, with having on the 25th day of April last, at the Lake Ferry, feloniously stolen, taken, and carried away two guns, his property. Mr Beard appeared for the prosecution, the natives and the half-caste conducted their own defence. The evidence of the prosecutor and another witness went to prove that on the day named the prosecutor and witness were on a small island hi.the lake, when the accused called "out from' the bank that they wanted to go on to the island. They were taken on to the island, and upon returning to the land they took possession of the two guns with which the prosecutor and witness were shooting on the lake, and after a struggle, went to their horses, and mounting, galloped away with the guns. In. answer to the Court the prosecutor said he had made no attempt to recover possession of the guns beyond laying the information in the case now before the Owurfc. The Court dismissed the information on the ground that there was no felonious intent on the part of accused, and no intention to keep' possession of the guns taken. They were, however, informed by the Court that they had been guilty of a serious offence in taking possession by force of tho guns. This they had no right whatever to do, and a repetition of such conduct might bring them into serious trouble. It was quite open to the prosecutor to take action against them for retaining the guns, and to recover damages for the detention,
