Patriot Cookery, deposed that he remembered . the horse- in question being sold-in-the pound. He author- 1 ,ised. some one'-to •purchase the horse, which was done, and.it.was brought tohis stables. He gave' evidence to the effect that Mr Hobinson had recognised the horse as the one he had lost, He (witness) had instructed.-Leahy, the policeman, to buy'h'im one at a certain price, and it was bought for £l They were to buy it between them "and share any profit; <- The 1 horse had since, been sold by Leahj- for £lB in Wellington, ■ He told- Leahy to jive £8 or £lO. for the horse. The horse was very' low in. condition when bought but picked: up quickly after a months' good feed, When Mr Robinson law the..horse in witness' paddock he claimed it as'his. ; -
William Sellar, sworn, deposed that he held apower of attorney from .Mr 'Payne. He authorized Mr RobinSon under that, power to .take for the recovery of the horse or-its -value.
The evidence taken, at .the District Court was accepted as evidence in this casa and the -various witnesses were put uv the bos to allow of cross-exam-ination by Mr Bunny, and tho Counsel having .addressed the.. Court,. His. Worship reserved judgment until the next sitting.; => -.-
