MASTERTON BOROUGH COUNCIL.

The ordinary. meeting of the above took place last night, Present—The Mayor and Cra Perry, Muir, Heron, Capper, Bacon and Hess6y, CORREBPOiVDEKCE, Inwards: From City of Dunedin Council with a recommendation-for a Bill to provide for the appointment of Fire Brigade Boards to control the Brigades throughout all Municipal Corporations. From Masterton Institute asking for a refund of license fee. '",. From Messrs Cole and Wrigley re a right of way in Section 20, Small Farm Block, stating the road was laid off before Masterton was constituted a Corporation, and asking the Council to accept th s road,' From certain ratepayers in Bannis-tei-'Btreet asking that a footpath may be formed in that street, and agreeing to pay their share of the same. From the County Council ofWairararapa East inviting the Borough Council to a conference re the Waipoua Bridge.

From Fire Brigade nominating • Cr' J, Muir, as Fire Inspector, From certain ratepayers residing on 'Section No. 20, Small Farm Block, again asking the Council to take action to have a proper and legal road laid off by the Trustees of Dixon's Estate. From Messrs Board k ; Gray on behalf of Messrs Olliver and Brown renewing their application for permission to open tha Borough ; roads for laying gas mains and pipes, From G. Russell re his claim against Mr B, P. Perry, for fee for inspecting his buildings, and asking to obtain a settlement of the same.—Referred tct tbe Finance Committee.

From A.-Cleghorn asking permission to remove a building from Town Acre 83, to Town Acre 85, Queen-street.

From J. Russell, building surveyor, reporting upon the alleged breach of the building regulations by Mr' Cleghorn, ■ " ••

. The Mayor said they would deal with Mr Russell's report jrst, and to .test the feeling of the meeting- he would move that the inspector's report be adopted. . Cr Perry seconded, Cr Heron thought a committee should 1)6 appointed. Cr Capper moved and Cr Heron seconded—That Ore Muir and Bacon be a committee to inspect and report on the building.

Cr Muir said witL respect to the 26 guage iron, the difference between the various makers varied considerably, but this guage had been repeatedly used without the Counoil interfering and he thought the by-law should be altered to meet the requirements. As far as the chimneys were concerned, he thought so long as the required thickness was there, that was all they wanted,

Cr Perry thought the report should bo adopted, Tho surveyor had passed the job,

, Cr Bacon thought the same, and that being so the by-laws had been broken, and tbey should rescind their laws rather than break them.

The Mayor said the surveyor had passed the job and gob his money, and the Counoil would not be able to hold the builder or owner liable. The Council would have to alter their laws or appoint a new surveyor. Cr Muir objected to be on the Committee.

Cr Gapper substituted his own name and Or Hessey'e, He said the surveyor's report did not contradict the alleged breaoli of the by-law, but rather confirmed it, The work had been taken in hand by the contractor without any authority being given by the Council or applied for by the contractor. If the Counoil thought fit he would be willing to have a report from a praotical man outside the Borough staff.

, Cr Perry said the surveyor had passed the work, and reported to the Council his satisfaction that the work was being done near enough to the bylaws,

The Mayor said he coincided with view taken by Cr Perry, that the surveyor had passed the building., - Cr Gapper then withdrew his amendmentand the question .lapsed. The next question dealt with was the application made by Mr Cleghom for permission to remove a building fern Mr Hare's section on Town Acre 83, Queen-street, to a section leased by him mm the Town Lands Trustees on Section 85, Bruce-street, His Worship said there was no occasion to apply for a permit unless the bylaws would be infringed. Cr' Gapper said the permit was necessary as the footpath would have to be crossed. The application was granted. Cr Gapper moved and Cr Heron

The request of the County Council to the Borough to appoint a Committee to meet them on the question of providing funds for the erection of ihe: Waipoua bridge either by a direct grant from the Borough or a toll gßte was considered.

• The Mayor said it must have become very hard lines with the County Council when they found themselvee compelled to call in the assistance of two other bodies before they could go into such a trifling matter as the £l2O required for the purpose of erecting another span to the Waipoua Bridge, the Government having found the rest of the money. Cr Perry moved, That the Borough do not appoint a deputation to meet the County Council or any other body to find fuuds to build the Waipoua Bridge. It was none of their business. His Worship pointed out that Cr Perry's object would be obtained by not moving ia the matter at-all.

the motion was lost. Cr Perry moved, "That the County Council be informed that Ilia Borough Council does not see its way clear to confer with, the County on the question of the Waipoua Bridge, as they had no responsibility in the matter." Cr Bacon seconded. H e failed to see the identity of interests of the Borough Council, and the County CouncilCarried.

The question of footpath formation in Bannißtor-stroot was referred to the Works Committee with instructions to proceed with the work on the usual share'of contributions being forthcoming.

The question of right of way on section No. 20 small farm block was referred to a committee consisting f Ore Bacon, Capper, Perry, and the Mayor to deal with and report at the next meeting of the Council,. An application from the Secretary of the Institute Committee for a refund of £2 2s, license fee paid for the Institute upper room, was referred' to the finance committee.:

The suggestions contained in a letter" f om the Dunedin City Council for a Bill to deal with fire brigades by co-operate bodies was laid on the table for the information of members, of the Council,

The report of the Finance Commit tee was read and adopted:—Accounts passed passed for payment: Graham & Duncan, 6s; McEwen, £3 8s; Payton k Co, £3 5s 9d; Smith & Hogg, £6 Jls 9d; Library Committee, £6 6s; E, Tooraath, £2 Hs: Keester t Harding, £l7s. . *

The Town Clerk was instructed to make fresh arrangements with the Library Committee for the rent of room for elections. '.-"-.

The works committee report was read as follows:

The Overseer's-report was read as follows: -Chapel street' contract will be finished to-morrow if the weather permits, I have reptoed and re-metalled'the footpaths in Church, Queen, Chapel, Dixon, Cole, and Bannister streets, • In three or fqur days the whole of the repairs to the' footpaths will be finished. I have cleared out the creek in Villa street and removed most of the logs from the river at the junction of Hops and Villa streets, I have cleared out the side drain on the right of South street, and am clearing the' other side now. As Crayne street is to ha made, I beg to suggest that the Kuripuni creek be diverted from the street through the property of Messrs Walton and Fybus, which will enable the Council to fill and form the whole width of the street. The persons interested are willing that the work should be done, to cost £l3.

Letters were read from Messrs Wilton and Pyhus agreeing to the diversion of the creak to their property provided the Bides wore protected with plauks and means of access given to the other side, It was resolved to recommend the Council to make tho proposed deviation of the Kuripuni oreek.. The wages Bheets were examined and sigued. It was resolved that the Council be reconimontlcd to supply Mr Adams with lewt No. 15 TimarU barbed wiee andlOlbsof staples as their contribution towards tho boundary fence.

In moving the adoption of the report Cr Heron said the deviation of Kuripuni creek would be a great saving to the Counoil in future,

The report was adopted. The Mayor moved that Cro Muir, Bacon and Gapper bo a committee-to get data as to the manner in which which the building regulations of the Borough were being carried out, and report to the next Counoil meeting. Cr Gapper seconded the motion which was put and carried. . The Mayor moved the motion standing in his name-" That where a chimney takes fire, if the occupant.of the premises pays the fine of 10s for the fire brigade within twenty-four hours to the inspector, further proceedings be not taken." Many times it was not the fault of parties not having chirnnies swept caused the fire, and it was hard to compel people to pay a court fee of 7s in addition to the fine.

Cr Gapper seconded, Cr Perry asked how-the by-laws would be effected by this being carried out.

The Clerk said no doubt any ratepayer could sue all the same any person for a breach of the by-law if they, chose so to do.

After some discussion the Mayor asked permission to hold the matter over until the next meeting of the Council, whioh was granted, and the meeting adjourned. •
