Uharles Moore was charged with being drunk and disorderly on the premises of tho Princo of Wale's Hotel on the 22nd iiisfe.
Mr Bunny defended the accused, and pleaded on his behalf previous good character and a public holiday. The police proved that the accused was fighting in the public street.
A witness called said he saw accused and another man hugging each other in the street, but he did not notice what they were doing, The Sergeant deposed that the accused when in the lock-up was violently
drunk, and uiacto uso of abominable language, Pined five shillings or twentv-fouv hours, ■ A second charge' of damaging a bucket at the lock-up was admitted, and an order made for tho value of the property destroyed, and a line of 20s, , .James Haigli was charged as being without visible means of support, -■ Sergeant McOardle deposed that tho accused was continually drinking and loiiflng about tho place, and sleeping in outhouses, • This had been going 011 for somo two months, Tho accused said lie had always paid his way, . Mrs Waggo, called, deposed that she knew the accused as a man who loafed about. He had asked her for food several times. Sho said if he cut some wood sho would givo him food, but ho said he could not work, She had seen him ask men for drink. The accused; I gavoyou my cheque. Witness: I changed you ono for two pounds, Tho accused : I have earned money since; I earned ten shillings from a native for breaking in a horse. Tho Court: Is this all you have earned 1 The accused: I 'have had a friend who helped nic, Mr Elloy, John Elley said lie had known tho man a long time, but could not say anything in his favor. The Court said it regarded tho accused as a loafer. There was not room in tho colony for men of such a class.- ' Tho accused offered to leave tho town immediately if ho were allowed to do so. The Court said it was reluctant to commit a man lor tho first time to gaol. It would give him a chance to turn over a new leaf. TIIH IiILIJAI'iD CASH. The adjourned case against Richard A, Grotty for a breach of the Gaming and Lotteries Act was proceeded with. John William Tattersall, nightwatchman at the Star Hotel, Wellington, remembered being in the billiard room of the Empire Hotel when Kraitiana and Grotty were playing, Money was chucked on tho (able. Pic believed it was put in the knds of tho defendant. Did not understand gambling himself. To Mr Board: Could not say absolutely it was money that passed, it might have been a picco of dirty paper. T. Thompson, licensee of the Empire Hotel, deposed that defendant was employed by him as billiard marker, and was paid a pound a week and board for liis services. ■ Mr Beard, for tho defence, submitted that a billiard room was not a gaming room under the statute, and that notice of the prosecution, required by law, had not been given, and that the evidence of witnesses did not substantiate the charge, The Court overruled Mr Beard's contention on tho legal points, Mr Beard submitted that it had net been shown that tho defendant was lessco of the room 011 tho dato when the alleged transaction took place. Ho was lesseo now, but it must bo proved that he was lessee then. The Court dismissed tho charge on the last point, which had been overlooked by the prosecution and by himself. [Left Sitting.]
