STEALING FOWL. Soren Ncilseu v. Galed Ewingtori (a boy about nino years of age.)— Stealing ai'own the value, of one shilling. Mr Bunny for .defendant, pleaded not guilty. Soren Ncilseu deposed that tho boycaught one of his chickens. He didn't see him take it as lie was not at home, Mrs Neilsen, wife of the informant, said she saw tho boy drive her "chickies" into Mr McCarthy's paddock and catch one. It was not the first time he had done the trick. (To Mr Bunny), A young lady was there, named Christiana Johnston, who saw .the affair. Mr Ewiugton claimed the chicken, She claimed other chickens. Witness moved her fowl becanse Mrs Ewington went to liej; fowl house at night, ■ The Court said that on the tacts revealed already there was no larceny. There might be ground for a civil action, but there was none for a criminal one, The information would be dismissed, but costs would not be allowed to dofendant.
