[Before H. S. Wabdell„K.M.| ' MABTERTON—THUBSDAY,; D.; F. McCarthy v, Mel and Diamond.—Debt £42. Mr Beard appeared for plaintiff, Mr Buckley for defendants. ' - - - This was a claim for the value of in order for goods supplied to Messrs Powell and Archibald, two contractor who were felling bush for defendants. J'lie men had given the order on their employers to plaintiff, who forwarded .it to Messrs Cattel and Diamond for liaymeftt, They, however, took no notise of the application, nor did they return the order, from which Mr McCarthy understood thafcthoyaccepted it, and sued upon it. Defendants denied having accepted the order, and as plaintiff could not prove: Ihey had done ro he, was nonsuited.
■His Worship remarked that .lie should not allow defendant's costs, as they had acted very wrongly in retaining the order iti their possession so long without intimating that they did not intend to honor-it. .
