IJb said thaj; after hearing the arguments of coifnsfilat Featherston on Monday, and giving them du,e consideration, he failed to see that tlje Resident Magistrate's Act conferred upon liim fluch power as iyould 'enable him .to convict in opposition 1 to flie opinion of a justice sitting with him on the Bench. : The Justice of the Peace Act gave no special powers to the R.M., and. the Resident Magistrate Act, 1876 only ;gavo the R.M, the power of two Justices when sitting alone. Under the circumstances.he did not .feel justified, in giving effect to, his v indi?i«Jual■.ppiriiou, in. r the;Oasei'.biit' to oal) a new justice or order a new trial 'if-coujieel iwj&hed. After an' argument between His Worship and counsel it was resolved that the 1 cm should ba adjourned: for .rehearing in a fortnight, Mr'Wardpll intimat•ing'.that besides Mr Lister-Kaye he should endeavor to secure' the attendance on thS Jpjjpji pf three other justices.
