Judgment for £lllss 3d ,=,, J. G. Rockel v T. H. Murray,-Debt £6 10s Gd. Judgment for amount and costs. J. Tuck v Hester & Taylor.-Debt £lB Bs. Mr Bunny for plaintiff, Mr Skipper for defendant. This was a claim for the services of a McCormack reaping machines, which cut 25A acres for defendant at 10s per day—£l2 15s—and for wire charged £5 13s. The sum of £l2 15s was admitted, the charge for wire being disputed. The plaintiff deposed that Mr Taylor agreed to pay him ten shillings per acre and extra for the wire, and called Mr Gapper, whose evidence tended to support the plaintiff's allegation. For the defence Mr Murray, of Te Ore Ore, Mr Rhodes Donald, and Mr J. Heggie were called, who proved that an Osborne machine was let last season at 10s per acre, inclnsiye of the use of wire, and that such a charge was a ressonable one. It was estimated by witnesses that from Is 2d to Is lOd per acre would be a fair charge for wire, and that it would pay to let out a machine at 7s 6d per acro.if the wire were charged separately. The case for the plaintiff was that a specific agreement had been made for 10s per acre and the cost of the wire added, but the Court held that this was not proved, and gave judgment for the amount paid into Court, and costs. . •
