J. E. Thompson was charged by Tlios. Warner witli an assault on the occasion of the late fire at Masterton.

Mr Bunny appeared for the prosecutor. The assault consisted of a blow or shove on the chest, and vas admitted by the defendant. It was proved that the prosecutor was a member of the Fire Brigade, and the Court, while admitting that itwould be a serious matter to interfere with a member of the Brigado while discharging the duties of his office, pointed out that prosecutor wore no uniform indicating his 1 official capacity, and apparently, too, the Brigade having been recently formed, there was not much organization on the part of its members. For these reasons the Court treated the case as one of ordinary assault of a trivial bharacter, and fined tho defendant ss. Mr Bunny pressed for solicitor's costs, and for expenses of a witness, but the Court refused to grant either. Jas. Ewington v. J. M.
