Magistrate’s Court.

BeforeJMeesrs Manchester and'Petit.Js.P.

Wednesday, Jas cary 25.

Mrs William Scott applied fora prohibition order against her husband. An order had been in force but had lapsed. He had been better in this district, but used to go to Oamaru. An order was granted for Waitaki and Oamaru.

A Waimate man pleaded guilty to a charge of drunkenness, and being a first, offender was convicted and discharged, with a warning not to repeat the offence. An application for a rehearing in the o»se of police v. Tilly King, was made. Mr Clement, solicitor, in the application, did so under Section 15, of the Justices of the Peace Act 1885, which provided that any Justice might grant a rehearing in any ease heard before him. The grounds under which the conviction was granted were that she bad been turned out oi hotels, second that she had been loitering, third, that the Fire Brigade, the building referred to, was in darkness, and fourth that -she had h»«n seen importuning people. Ho would be pleased if the Justices would .mention any other heads that might occur to them, and ha would deal with them.

The Bench said that a rehearing was freely granted. Sergeant Wasting asked for sufficient time, say a week. This would be enough,, as Constable Christie- was the only likely police witness. i The Bench said this would of course he done in justice to both sides. The rehearing could take place that day week. The money deposit necessarily .by law would be fixed at £2. It scarcely seemed necessary to fix.any sum, but it was mentioned by law. The case will bo reheard at 10.30 a.m. on Wednesday, February Ist. 1
