Magistrate’s Court.
Waimate, December 5.
Before Messrs W. Ooltman and W. Petit, J.P-’s.
A Wairaate young man pleaded not guilty to a charge of striking Rev. J. Carlisle with an egg on the evening before the general election. In his evidence later, defendant said he could not remember whether he hit Mr Carlisle or not.
E. J. Atwill, C. Wilson and H. Saunders also gave evidence. Defendant was convicted and fined 10s, with costs 15s.
The case of Police v. H. Dunn, on a charge of threatening to shoot J. Wergus with a revolver, again came on for hearing. J. Werges, in his evidence, was not very clear as to whether he had been threatened, or whether a revolver was pointed at him, though- he had been positive formerly. Constables Christie and O’Halloran gave evidence as to the finding of a revolver on Dunn’s person when he was arrested.
The other witnesses were H. Baker and A. Harris.
The Bench said they were of opinion that there was more in the case than appeared on the surface. Though the police could not be blamed, it was a great pity that the case had not come on sooner as then the witnesses would not have suffered so much from loss of memory. However, as there was a doubt, Dunn would have the benefit and the case would be dismissed.
