Magistrate’s Court.

Thujrsuay, July 4,
A case of supplying liquor to a pro hibited person was adjourned till the 13th inst. CIVIL casks. Ambrose Jackson v, Bowker, claim £37 12s, fruit supplied. Mr Hamilton for plaintiff, who desired to have his evidence taken in Christchurch. The case was adjourned till the 18th inst, Maindonald v. Hardwick, claim £8 10s, for goods oidcred, and of which receipt had been refused. No appearance of plaintiff. Mr Hamilton under Section 100 of the Magisirates' Court Act, asked that tho case be struck out and that costa be allowed defendant. Tho Bench said tho action could be re instated.
Tho plaintiff here appeared and gave evidence of having received a verbal order for the goods. Wa’ter W lao i. engineer in the employ o Mr Maindonald, gave evidence ih it Mr Hardwick told him he had md a e l goods similar to those in question about the middle of February.
For the defendant, Mr Hamilton submitted that the order had been given under the stipulation that it was to be do ie at a certain time. Tingoods did not come to hand in time, and he con idered the matter ended. William Hardwick, defendant, do posed that when the goods came ttf hand the engineer, who was fixing Mr Maindonald’s mill, was unable to stay in Waimate. Defendant wva unable to wait till tho man came back, and said so. Heard no more about the matter till three weeks ago, when the goods were sent up and be refused to take d livery. Plajntiff was non-sUilcd, with £1 Is solicitor’s fee.
