REQUESTS BY ACCUSED
PRISONER WANTED AS WITNESS
RULING BY THE JUDGE
tßy Telegraph—Pnss Association.) AUCKLAND. Tins Day. At the hearing in the Supreme Court of the gaol-breaking charges. O'Hehir. one of the accused men, asked that lie should be allowed to call a prisoner. Watson as a witness. Nir Justice Blair said the request could not bo granted, but if O'Hehir wished to press the matter. the request might be granted and O’Hehir given a separate trial. O’Hehir said he would not. press the point except to remark that no man in his senses could truthfully have made such a statement as Watson's statement to the police.
The Judge said that was a matter O'Hehir could comment on to the jury. Accused. Smith, informed the Court that owing to their late arrival at the prison last evening and the fact that lights were out at 8.45 p.m.. he and O'Hehir had not hud sufficient time to prepare their statements in defence
and would like an hoqr for that purpose. The Court adjourned for an hour and a half.
