STAY OF EXECUTION
SENTENCE ON MELBOURNE WOMAN. APPLICATION IN ISAACS CASE. (By Telegraph—Press Association—Copyright) MELBOURNE, November 4. The order made in the County Court by Judge Foster in sentencing Edna Frances Isaacs to be held for 14 days in custody was stayed today on an application made by her counsel. A new order was made calling upon the bailiff to show cause why he should not be prohibited from executing Judge Foster’s order. Since the custody order was made the woman has been in a private hospital and medical evidence was given today that she was unable to attend the Court. The basis of the application today was that Judge Foster had no power to sentence Isaacs for a criminal offence without calling on her to show cause why she should not be punished for contempt of Court.
The custody order was made against Mrs Isaacs after she had failed in a civil claim against her husband, a brother of Sir Isaac Isaacs, former Go-vernor-General of Australia. She was severely denounced by Judge Foster for her conduct during the hearing.
