DAMAGES CLAIM

PEDESTRIAN CROSSING ACCIDENT. MAJORITY DECISION REACHED BY JURY. (By Telegraph—Press Association.) WELLINGTON. This Day. Returning with a majority verdict for suppliant, the jury in the Supreme Court, Wellington, which heard the suit of Ellen Lucy Codd, married woman, for £57 19s special damages and £1250 general damages, fixed special damages at the full amount claimed and general damages at £5OO. Respondent was the Crown. The jury was in retirement five hours, including the evening meal time. Two of the 12 men dissented. Judgment was not entered lor suppliant, leave being granted for respondent to move within 14 days. While Mrs Codd was crossing Museum Street at a pedestrian crossing she became frightened at the approach of a Post and Telegraph Department motor-ear, slipped and fell, injuring her right wrist. It was said she had lost the use of her right hand. The driver of the car was Richard Oscar Boyens, an overseer. Mr Justice Northcroft was on the bench. Mr C. Evans-Scott appeared i for suppliant, and Mr C. A. L. Treadwell, with him Mr 11. Mitchell, for respondent. ______
