MAGISTRATE’S COURT

BUSINESS AT MASTERTON SITTING. MOTORING & OTHER CASES. The fortnightly sitting of the Masterton Magistrate’s Court was held this morning before Mr H. P. Lawry, S.M. On a charge of driving a car in High Street on October 3 without due care and attention, Albert Charles Duncan was fined 30s and costs 11s. For failing to give way to traffic approaching from the right at the intersection of Villa Street and Lincoln Road, on November 23, Agnes Torstonson was fined 30s with costs 10s. The charge arose out of a collision at the intersection between two cars, in which defendant’s car was overturned after, having struck the other vehicle a glancing blow. Defendant was not injured and little damage was done to the car.

James Bruce Rutherford was fined £3 and costs 10s for driving a motor van between the bridges in Queen Street at a speed exceeding 30 miles per hour. Constable R. Berry estimated defendant’s speed at 45 miles an hour.

For driving a motor vehicle in Queen Street at a speed exceeding 30 miles per hour James Michael Brice was fined £5 and costs 10s. Constable Downes estimated his speed to be at least 50 miles per hour. On a charge of having no driver’s licence Brice was fined £1 and costs 10s.

For parking his car on a fireplug in Queen Street, David Peter Donald was fined 10s and costs 12s.

For riding a bicycle at night without a light, Leo Myers, Eric Torwick and Ernest Hubbard were each fined 10s and costs 10s.

William B. Watkins for operating a motor vehicle without having a heavy traffic licence was fined £2 and costs 10s. Defendant was prosecuted by Inspector McGregor. For having no warrants of fitness for their motor vehicles Kenneth Wright, Hector Tagg and Joe Yee were each fined 10s and costs 10s while George McKay, Edward L. Hooper, Berney Savage and Allan Sanson (motor cycle) were each fined £1 and costs 10s. The informations were laid by the borough traffic inspector, Mr J. McGregor.

Charges of carrying out plumbing work in Masterton without being a licensed. plumber and without having a permit were preferred by the borough health inspector, Mr Russell, against Alexander James Harker Briden. Defendant was fined £1 and costs 10s on each charge. Mr Burke, deputy-radio inspector, proceeded against Clarence Patrick Ward for having no radio licence. Defendant was fined 25s and costs. On the information of the borough poundkeeper, Mr J. Henderson, charges of allowing cattle to wander were preferred against Wong Nam and Alfred Percy Southey. Wong Nam was fined 10s and costs 22s 6d and Southey £1 and costs 23s 6d. A charge against Donald Lockwood Goldfinch for parking his car in Queen Street longer than the specified time of 45 minutes, was dismissed. Mr J. McGregor, borough traffic inspector, said the car was parked outside a shop from 11 o’clock at night until 11.30 o’clock the next morning. As there were no signs in the street specifying the length of parking time, the Magistrate dismissed the case. CIVIL CASES. Judgment for plaintiff by default was given in the following cases: Thomas Jordan v D. J. lorns, £6 3s, costs £1 Ils 6d; J. C. Ewington v C. Gartner, £1 16s lOd, costs 9s; Hallenstein Bros Ltd v E. Doherty, £2 6s, costs £1 3s 6d; T. T. Redmond v W. Watts, £3 3s, costs £1 5s 6d; Morrison and Gilberd Ltd v F. M. Rogers, £2 ss, costs £1 7s 6d; Para Rubber Co, Ltd v C. J. McHardy, £4, costs £1 3s 6d; Hugo and Shearer Ltd v T. W. McConnell, £3 12s, costs £1 7s 6d; New Zealand Farmers’ Co-operative Distributing Co Ltd v James MacDonald, £1 4s sd, costs 15s; William Taylor v S. Ludemann, £25 and possession forthwith, costs £4 11s 6d; McKenzie and Marsack v Herbet George Southey, £5 ss, costs £1 10s 6d. In a judgment summons case, the Dominion Motors Ltd v A. R. Popple, judgment was varied, the sum of £3 18s 6d to be payable at 2s 6d per week. In the case of George Dallas v Sidney Arthur Bishop, judgment was varied, the sum of £23 3s to be payable at 5s per week for three months and thereon at £1 per week.
