CLAIM FAILS.
GREYTOWN HOTEL LEASE WELLINGTON, March 31. Judgment for the defendant was given by Mr. Justice Northcroft in a reserved decision in the Supreme Court to-day in the case in which George Valentine Jackson, of Waihi, claimed from Mrs Mary Manson £l6lO 10s.
The plaintiff alleged that the defendant had failed to comply with an agreement to lease the Greytown Hotel to him, but his Honour upheld the contention of the defence that the memorandum of agreement relied upon by the plaintiff did not comply with the provisions of the Statute of Frauds, in that when delivered as an offer, it did not name the person to whom it was addressed.
His Honour added that it might be convenient, in case of appeal against the judgment, for’ him to state his opinion of the damages to which the plaintiff would have been entitled had he been successful. After considering all the evidence his Honour assessed those damages at £175.- —(P.A.).
