KARL V. KUSABS.

The following is the full text of the award given by the arbitrator in the case of Annie Karl v. Henry Kusabs and Emily Kusabs: — Whereas by an order of the Supreme Court of New Zealand, Northern District, made at Auckland on Monday, the 6th day of December, 1897, on the trial of this action, it was ordered by the said Court that all questions and disputes in this action should be tried before me, William James Hunter, of Ohaupo, in the colony of New Zealand, auctioneer, such reference to be under the Arbitration Act, 1890. Now I the said William James Hunter having taken upon myself the burden of this reference and having duly weighed and considered the several allegations of the said parties, and also the proofs, vouchers and documents which have been given as evidence before me, do hereby make and publish my award in writing of and concerning the matters so referred to me in manner following, that is to say :—I award and adjudge that the plaintiffs are entitled to the sum of £1 18s, together with £3 15a costs, being the amount paid into the Magistrate's Court at Te Awamutu ty the defendants. And I further award and direct that each of the parties hereto do bear their own costs in the Magistrate's Court and in this Court and their costs in this arbitration, and I do further award and direct and fix the costs of this reference and my award at £ls 9s, and that the plafutiffa do pay one moiety thereof and the defendants the other moiety thereof, in witness whereof I have hereunto subscribed my name and affixed my seal this 13*b. day of January, 1898. The award in the case of Joseph Karl v. the sime defendants, heard at the same time, is the same, execpt as to the money paid into Court, making the total fee charged by the arbitrator £3O 18s, half of which is to be paid by each party.
