Bail breached, bail granted

Wati Makiri, a 48 year old unemployed labourer from Auckland appeared in the Ohakune District Court May 24 on four charges relating to incidents which occurred in Raetihi on May 12.

He pleaded not guilty to all the charges. The charges were: breach of a non molestation order, two of intent to intimidate and one of assault. His counsel asked that bail be granted despite Mr Makiri having breached the bail conditions on May 12 of other charges h e faces. The Police argued that if bail was given there was no way to protect the witnesses and that Mr Makiri had already breached bail conditions. Judge Lowe said he could see little reason to grant bail. Counsel said because the defendant had elected to be tried by a jury and the next possible date for that would be in August he would be in custody for several months if not granted bail. Mr Makiri had not intentionally travelled to Raetihi on May 12, his counsel told the court. He had been offered a ride to Auckland and the driver of the car had decided to go via Raetihi and stop in at the Raetihi Hotel where Mr Makiri's estranged wife was drinking.

Wati Makiri had appeared in court that day and was remanded on bail and ordered not to visit Raetihi or make contact with his wife or daughter. The defendant and his wife had been encouraged by others to meet to discuss their children said his counsel. The judge said Mr Makiri would be punished more severely than was warranted by the offences if he remand in custody. Wati Makiri was granted bail on the following conditions: that he be placed on the train to Auckland by the police and remain in custody till then; that he report to the Papakura police at 2pm each day, starting May 25; that he observe a curfew from 10pm till 8am; that he not visit Raetihi; that he not make contact with the complainant or prosecution witnesses.
