OHAKUNE DISTRICT COURT

The following cases 'were heard by Judge E.W. Unwin in the Ohakune District Court last Thursday. Sergeant Neil Coker of Ohakune appeared for the police prosecution and Traffic Officer Ian Harrison appeared for the Ministry of Transport. A A A Thomas Henry Ball, selfemployed farmer of Ohakune, pleaded guijty to a charge of driving with excess blood alcohol in Conway Street, Ohakune, on Saturday 8 August. He was convicted and fined $300, court costs $55 and ordered to pay medical and DSIR fees totalling $144. He was disqualified from driving for 6 months. Counsel: D.G. Harvey. AA A Dennis Mason Peihopa Bishop, 19, work scheme trainee of Ohakune, pleaded guilty to a charge of being unlawfully in a building on the night of 9 October. Court heard how ihe complainant, a young woman, had awakened in her home in Conway Street, Ohakune at 1 ,30am to find defendant leaning over her bed. Complainant told police that she had been alarmed by the experience. Through counsel, defendant explained that he had been drinking since 2pm the previous day, was drunk at the time of the offence and was only looking for money having spent all he had on the previous day's drinking binge. Court was told that defendant had taken out a self-imposed prohibition order for 12 months during which he undertakes not to frequent hotels or consume alcohol. He was convicted and sentenced to 4 months non-residential periodic detention. Counsel: D.G. Harvey. A A A Reihana Paul Davidson, 19, shedhand of Raetihi, pleaded guilty to one charge of causing intentional damage to a parit bcnch belonging to the Raetihi Borough Council and to two charges of intentionally breaking windows, one at Images Unisex Hair Salon and one at Trustbank Wanganui in Seddon Street. All these offences occuired on 21 November. He was convicted and sentenced to make total reparation of $1300 at the rate of $70 per week or face a 90-day term of imprisonment in default. AAA Philiip Hamley EUery, 26, garden hand of Ohakune, pleaded

guilty to careless use of a motor vehicle in Mangawhero Terrace, Ohakune, on 23 October and to a charge of having no driving licence. Court heard how defendant had rolled a Mitsubishi vehicle after losing control and hitting a traffic sign as he negotiated the "s-bend" between Goldfinch Street and Mangawhero Terrace. He was convicted and fined $100, court costs $55 on each charge and disqualified from driving for 6 months. AAA Graeme Raymond Hewitt, 33, carpenter of Tauranga, failed to appear on a defended charge of driving while disqualified. Following his non-appearance a warrant for arrest was issued. AAA Philiip Jerry Hiroti, 18, unemployed labourer of Raetihi, was to have defended a charge of assaulting Todd Peck at Todd's Tasty Takeaways on 27 June. However when he appeared in Court he changed his plea to guilty from the not guilty plea he had made at last month's hearing. He was convicted and sentenced to three months non-residential periodic detention. Counsel: D.G. Harvey. AAA Donald Daniel Kui, 24, unemployed gardener of Marton, was to have appeared to face charges of obstruction, intentional damage, failing to leave a licensed premises, disorderiy behaviour, theft and breach of periodic detention. Failing his appearance to answer these charges a warrant for arrest was issued. A A A Darreil Shaun McLeod, 24, restaurant manager of Waiouru, faced a charge of driving while disqualified in April this year. Court heard how defendant had been disqualified for two years in 1985 and ihought this period of disqualification had expired when he drove in April. That was not the case though the period has now expired. He was advised to sit and obtain another driving licence so that he could legitimately use a motor vehicle in the course of his catering business in future. Palmerston North, pleaded guilty to one charge of possession of cannabis and to one charge of supplying a Class C drug (cannabis) on 25 July. Court heard how defendant had given a friend a cannabis hullet' and, following a subsequent search of defendant's bedroom in Rangataua, 5gms of cannabis was found. In convicting and sentencing defendant to 6 months non-residential periodic detention at the Palmerston North work centre, Judge Unwin said society should have nothing bui contempt for those who get involved in supplying an illegal drug. Counsel: P. Brown. A A A Stephen Patrick Munroe, 17, shed-hand of Raetihi, pleaded guilty to intentionally damaging three windows in Raetihi on 19 October. Damage was assessed at $400. He was convicted and ordered to make full reparation of $400. A A A John Kevin Shane Phillips, 26, bus driver of Auckland, was to have appeared on a charge of common assault which occuired in Ohakune on 17 July this year. Police requested and were granted a warrant for arrest of defendant as he continued to fail to respond to summonses sent to him. A A A Peter Arthur Phillips, 23, unemployed of Raetihi, appeared for sentence on three charges to which he had been found guilty following a defended hearing last month. On these charges: possession of cannabis; obstructing a police constable in the execution of his duty; receiving a stolen firearm, he was convicted and sentenced to 5 months non-residential periodic detention and to 12 months supervision in order to undertake drug and alcohol rehabilitation treatment. He was also ordered to pay $100 towards the cost of prosecution. Counsel: P. Brown. A A A Darryl Wayne Pickery, 17, catering course trainee of Ohakune, appeared for sentence on several charges including burglary, assault, theft, disorderiy behaviour and intentional damage. In convicting and sentencing defendant to 6 months community care under the Marae Catering Course and ordering him to make reparation of $1900 within three months or face a period of corrective training, Judge Unwin said that he had seriously con-

sidered imposing a sentence of corrective training in the first place. However, though defendant had obviously been involved in criminal activity at a very young age, it was felt that by sending him away t o corrective training he would become involved with other young criminals and so set a pattem of future criminal behaviour. Instead, the Court was prepared, as "an act pf faith", to give defendant a chance of making reparation and following a course of training for a career in which he showed some aptitude. "If you fail and resort again to criminal behaviour you will be letting down not only yourself but your sponsors and supporters on the Marae Catering Course as well as the Court system which is prepared to give you this chance", said Judge Unwin. A A A Anthony John Pikari, 20, unemployed of Raetihi, pleaded guilty to one charge of breaking and entering a premises in Ward Street, Raetihi, on 11 June, one charge of stealing a Honda motor vehicle valued at $1400 from the same address on the same date, and to one charge of burglary from the Waimarino Squash Club on 8 November when various items including beer and club jerseys were stolen. Reparation of $1709 was sought Court heard how defendant had an alcohol problem and had now taken out a prohibition order under which he undertakes not to frequent hotels or consume alcohol for 12 months. He was convicted and remanded to appear in the Ohakune District Court on 17 December for a probation officer's report and sentence. Counsel: D.G. Harvey. A AA Stephen Charles Pue, 17, unemployed of Raetihi, pleaded guilty to misuse of a telephone the property of Telecom NZ. Court heard how defendant had charged toll calls amounting to $55.97 to a transferred number between 1 July and 30 September this year. He was convicted and fined $125, court costs $55 and ordered to make reparation of $55.97 to Telecom NZ. Payment of the fine was to be made at the rate of $20 per week. Counsel: P. Brown. A AA Ray Pui, 25, unemployed shearer and Piki Lois Pui, 24, unemployed shearer, both of Raetihi, were to have

appeared on a defended hearing related to an alleged breaking and entering offence which occurred on 1 1 September at the Cedar Service Station in Ohakune. Because of the likely length of the hearing during which the defence intended calling six witnesses and the prosecution four witnesses, the case was adjoumed to 5 February 1988. A AA Robertson Te Huia, 46, bridge worker of Ohakune, pleaded guilty to a charge of driving with excess blood alcohol on Dreadnought Road on 28 August. Court heard how defendant had been an unfortunate victim o f circumstances. While driving along Dreadnought Road on the day in question, defendant's car was struck by another motor vehicle whose driver was at fault. As a result of this accident defendant's car, valued at $4,000, was 'written off and defendant landed up in the Waimarino Hospital where, fqllowing routine blood tcsls, the alcohol level was found to be slightly above the permissible amount. He was convicted and fined $175, court costs $55 and ordered to pay $32 medical expenses and $59 DSIR fees. A six-month period of disqualification was imposed. A A A Tina Christina Maria Van Kan, 19, unemployed of Matata, pleaded not guilty to a charge of theft of a packet of cigarettes from Ohakune New World on 23 October. She was remanded on bail to appear in the Ohakune District Court on 5 February 19S8 for a defended hearing. Counsel: D.G. Harvey. A A A Michael John Whale, 17, and Christopher John Zimmerman, 22, both market garden hands of Ohakune, appeared in dock together to face Ministry of Transport charges relating to an incident in Anzac Parade, Wanganui, on 12 May. Court heard how a car being driven by Zimmeiman had been ordered to stop when a lighting defect was detected by a traffic officer. It failed to stop immediately but did so in a nearby side street. When the traffic officer arrived he found defendant Whale occupying the driver's seat. A breath test (from Whale) proved negative. Both defendants later admitted the 'switch' to the Ministry of Transport. They were each fined $275, court

costs $55 and Zimmerman was disqualified from driving for 90 days. Counsel: D.G. Harvey. A A A Ashley Darren Webb, 21, unemployed of Raetihi, appeared for, sentence on a charge of theft relating to a defended case which was heard in the Ohakune District Court last month. He had been found guilty of stealing a car radiator and two motor vehicle seats from a property in Tawhero Road, Ohakune. He was convicted and sentenced to make reparation of $180 at the rate of $20 per week and ordered to pay $25 towards witness expenses. Counsel: D.G. Harvey. A A A A 27-year old Raetihi man was granted interim suppression of name, faced one charge of sexual violation and one charge of indecent assault. He was remanded wilhout plea to 17 December for the taking of depositions on the condition that he has no contact or association with the complainant families. Counsel: D.G. Harvey. A A A
