OHAKUNE DISTRICT COURT

In the only defended case heard in the Ohakune District Court last Thursday a Car Haulaways driver was charged with crossing a yellow 'No Passing' line on SH49 during an overtaking manoeuvre. Graeme Robert Huxford, driver of Paraparaumu, pleaded not guilty to an MOT charge of failing to keep left of a yellow 'No Passing' line. Court heard how defendant, driving a Car Haulaways truck and trailer unit, was alleged to have overtaken another vehicle on SH49 west of the Winstone Karioi Pulpmill on the incorrect side of the road. The driver of the other vehicle, Raewyn Pearson of Ohakune, said that she had

seen the yellow 'No Passing' line between her car and the Car Haulaways truck during the overtaking manoeuvre which occurred on 28 May 1986, while both vehicles were travelling towards Ohakune. She said that, after picking her husband up at the Mill after work at 4.10pm, she had turned right onto SH49 and headed for Ohakune, having checked the road was clear. About a kilometre west of the Mill entrance she became aware of the Car Haulaways truck behind her. As it passed she had felt 'cramped' even though she had pulled over to the lefthand side of the road so that her near-side wheels were on the metalled shoulder of the highway. The prosecution case

relied on the testimony of this witpess, two traffic officers and the manager of Car Haulaways in Paekakariki who confirmed that defendant was the driver of the truck invOlved. The defence case involved argument about the delays in notifying defendant of the allegation. As a result of these delays it was claimed defendant had no recollection of the incident. In his summing up Judge Unwin said that after hearing the evidence he was convinced the incident had occurred but there may have been mitigating circumstances had the driver remembered the incident ... "but it would be difficult to imagine what the defence might have been." Defendant was convicted and discharged. Counsel: P. Brown.
