OHAKUNE DISTRICT COURT

The following cases were heard by Judge E.W. Unwin in the Ohakune District Court on Thursday 20 September 1984. Colin Barry Phillips, 28, forestry worker of Raetihi, was granted a re-hearing on a charge that he stole a winch valued at $1,000 on 1 January. Mr D.G. Harvey told Judge Unwin that he was now in possession of evidence not available to him in July when the charge was first heard. His Honour set the rehearing date for 15 November. ★ ★ ★ Sandra Rae MacDonald, 27, unemployed of Raetihi, pleaded guilty to stealing a fur jacket valued at $200. Represented by Mr P.G. Brown, the defendant was told by His Honour that although the crime was a spur-of-the-moment one, she subsequently tried to make a profit from the jacket. He convicted and fined her $175.

★ ★ ★ George Ashford Pekamu, 1 7, unemployed of Ohakune, pleaded guilty to possession of an offensjve weapon at Papakura in Auckland in circumstances that suggested an intention to use it to commit an offence involving fear of violence. Pekamu was convicted and remanded to 1 8 October for a probation report and sentence. Bail was set at $750. ★ ★ ★ A warrant for the arrest of Maria Vicky Nanette Herewini, also known as Mareikura and formerly of Raetihi, was issued by Judge Unwin. She had failed to appear to answer a charge of failing to report to her probation officer. ★ ★ ★ Stanley Nathan, 18, unemployed of Raetihi, was fined $150 and ordered to pay compensation of $2 1 7 to the Gretna Hotel, Taihape, within three months or in default, be imprisoned for

six months. Nathan punched out the windows after being ejected from the hotel and was himself so badly injured that he was admitted to Taihape Hospital then Wanganui Base. ★ ★ ★ Clinton James Bishop, 2 1 , unemployed of Raetihi, was fined $300 and disqualified from driving for six months after pleading guilty to having a breath alcohol level of 650:1, at Tauranga on 19 November 1983. ★ ★ ★ Phillip Gerry Hiroti, 24, shearer of Raetihi appeared for sentencing on a charge of trespassing in the Raetih Hotel. He also faced six more charges of entering the hotel. These charges were subsequently withdrawn by the police because he had not caused any trouble on the latter occasions. Judge E.W. Unwin jailed Hiroti, on the charges for which he had already been convicted, for a total of six months.

★ ★ ★ An unemployed 17 year old Raetihi youth whose name was suppressed, was placed in Manawatu Youth Prison for three months after the court had heard three charges against him of having intercourse with a girl under the age of 15 and indecent assault on another girl. Mr D.G. Harvey told the court that there appeared to have been a considerable degree of compliance on the part of the complainant in the indecent assault charge, further supported by the fact that the incident occurred in February and no complaint was made until September. In respect of the charge of intercourse, it was not disputed that the girl was at all times a willing partner. In his submissions, Mr Harvey recommended probation which the judge set at 12 months in addition to the sentencing of youth imprisonment.
