Town Planning So The Hobbit can now operate as a public restaurant. I suspect "Satisfied rate payer ... for now" expresses a widely held feeling of satisfaction. However, the implied criticism of the Council in that letter is based on an incorrect premise. The Town Plan is law and Section 62 (3) of the Town and Country Planning Act provides that a Council must comply with its own Town Plan. Any decision made contrary to the provisions of the Town Plan is a nullity both in fact and in law.

A person who fails to comply with the provisions of a Town Plan renders himself or herself liable to a fine in excess of $10,000.00. To claim that the Town Plan is a guide and not law is akin to saying that the Crimes Act contains a collection of suggestions!
