chapman, tinker, caster of metals, mender of chairs, and. every person wiio without any horse or beast bearing or drawing burden, and the term “ Hawker ” shall be taken to mean and include every pedlar, petty chapman, tinker, caster of metals, mender of chairs, and every person who with horse or other beast bearing or drawing burden, travels and trades from place to place or to other men’s bouses carrying to sell, or exposing or offering for sale any goods, wares, or merchandize, or carrying to sell or offering or exposing for’ sale in any public thoroughfare or at private houses any goods, wares or merchandize or carrying and exposing any samples or patterns of any goods wares or- merchandize afterwards to be delivered or procuring orders for goods wares or merchandize immediately to bejdelivered or selling or offering for sale his skill in handicraft : Provided always that nothing in this Bylaw contained shall render it necessary for it license to be obtained by tiie following persons as such ; (that is to .say): (1) Commercial Travellers or other persons selling or seeking orders for. goods wares or merchandize to or from persons who are dealers therein or selling or seeking orders for books as agents authorised in writing by th ) publishers of .such books (2) Fishermen or. persons employed by them hawking or selling newly caught fish other than shell fish (3) Butchers selling meat or offering the same for sale, bakers selling bread or offering the, same for sale, or milkmen selling milk or offering the same for sale, in the ordinary course of their trades. In this By-law the expressions “ licensee ” and “ licensed person ” mean the holder of a license dulyissued to such holder as hereinafter provided, and which shall not have expired. 3. No person shall trade or act as a Pedlar in Hobson County without being duly licensed as hereinafter nrovided, to trade and act either as aPedlar orllawker. Any person so trading or acting without being duly licensed so to do in manner hereinafter provided shall be liable to a penalty not exceeding Five Pounds for every such offence. -1. No person shall trade or act as a Hawker in Hobson County without being duly licensed in manner hereinafter provided to trade and act as a Hawker. Any person so trading or acting withaut being duly licensed so to do in manner hereinafter provided shall be liable to a penalty not exceeding Five Pounds for every such offence. 5. Every person who shall desire to obtain a license under this By-law shall make application in writing to the Clerk. Every such application shall be in the form of the First Schedule hereto and shall state the name and usual place of abode of the applicant and the nature of the license sought to be obtained, and shall be accompanied by a sum in money or Past Office Order equal in amount to the sum payable to the County Fund for the license in respect of which application is made. As soon as conveniently may bo after the receipt of such application the Clerk shall consider the same and may require the applicant to give such security for his good behaviour during the currency of the license or to adduce such evidence of fitness and good character as he, the said Clerk, may think fit, arid may in his discretion grant or refuse such license. Any applicant feeling himself aggrieved by the refusal of his application by the Clerk, may within seven days thereafter by writing under his hand and delivered to the Clerk at the office of the Council, appeal to the Council, and the Council shall at its next meeting consider such appeal and may grant or refuse such license. Every such appeal to the Council shall be in the form of the Second Schedule hereto and shall be accompanied by a sum in money or Post Office Order equal to the amount payable to the County Fund for the. license sought to be obtained. If any application or appeal shall be refused the amount accompanying the same shall be returned to the'applicant but if a license shall be granted on any such application or appeal the amount accompanying the same shall be applied in payment of the sum payable to the County Fund for such license. 6. Every Pedlar’s License granted hereunder shall be signed by the Clerk and shall be in the form of the Third Schedule hereto and shall authorise the person named therein (but not the agents, servants, or legal representatives of such person) to carry on the business of a Pedlar within the County until the Thirty-first dav of December in the year in which the same shall be issued (unless cancelled by the Council) and no longer. Every Hawker’s License granted hereunder shall be signed by the Clerk and shall be in the form of the Fourth Schedule hereto and shall authorise the person named therein (but not the agents, servants, or personal representatives of such person) to carry on the business and to act as either a Pedlar or Hawker within the County until the Thirty first day of December in the year in which the same shall be issued (unless cancelled by the Council) and no longer. 7. Every licensed person shall deliver up his license to the Clerk when so to do by the Clerk by notice in writing under his hand. S. If any licensed person shall be convicted of any felony or misdemeanour or of any offence against the provisions of this By-law or of any offence punishable on summary conviction, or if any such person shall fail or refuse to deliver up.his licence to the Clerk when duly required so to do or for: any other sufficient cause the Council may cancel the license issued or granted to such person and thereupon such license and all the rights of the licensee thereunder shall absolutely cease and determine. 9. No license shall be granted or issued hereunder to or in the name of any firm partnership or corporation or to or in the name of more than one person. 10. There shall be kept in the offices of the Council by the Clerk a register of the Pedlar’s Licences and also a register of the Hawkers’ Licenses issued hereunder shewing the number and date of each such license and the name and address of the person to whom the same shall have been issued. When any licensed person shall be convicted of any offence against tbe provisions of this By-law tbe Clerk shall enter in tbe Register and sign a memorandum to that effect. When any license shall be cancelled by the Council a. memorandum recording the fact shall be entered in the Register and signed by the Chairman. The Register shall be open during- office hours for inspection without payment by any Justice of tbe Peace, Constable, Peace Officer, Councillor or Officer of this or any other County or Borough and to any other person on payment of a fee of One Shilling. Any person shall be entitled to receive from the Clerk a certified copy of the entries made in either of the Registers with respect to any one license issued hereunder on payment of a fee
