A MOTORING FATALITY.
ALLEGED NEGLIGENT DRIVING. JURY FAILS TO AGREE. PALMERSTON N., February 9. The jury failed to agree in the case in which John Drummond was charged with negligently driving a car on the Wocdvillc-Pahiatua Road on November 13 so as to cause the death of a youth named George Vinton. A new trial was ordered to take place at the May session of the Supreme Court. Drummond, who was admitted to bail, is 73 years of age, and a well-known resident of Dannevirke who has held many prominent positions in public life. The facts of the case, which are not disputed, are briefly as follows:—Vinton was knocked down by a car driven by Drummond, receiving injuries from which he died. The road at the scone of the accident is straight, with a clear view for aboir a. mile, and the mishap occurred in broad daylight. Drummond in the Lower Court stated that he was unable to account for his not seeing the boy. The car had side curtains, and it was suggested by counsel for the defence that deceased had temporarily left the road for some reason, unfortunately to rejoin it as the ear passed. No evidence was calk'd for the defence. —(P.A.)
