AN INTERESTING CASE.
QUESTION OF LIABILITY. A case was heard in the Magistrate's Court at Carterton on Thursday, in \vhich Will'am Alfred Collins, labourer, lof Feathers'ton, claimed from H. H. AVolte'rs, of Oartertcfo,£so, damages sustained to a horse, gig,, and 'harness as a result of a collision- between the plain'tiiff's gig and the defendant's motor car, alleged to have Ibeen -Negligently driven by Dudley Byrne -while in the employ of defendant, on the night of AprO 20th last. Mr J. W. Card, of'Featherston, appeared for plaintiff, a'nd Mr T. E. Maunsell for defendant. After hearing evidence and argument, His Worship stated that though it was a fact- that Byrne was a servant, he was acting without his master's authority, and under these dir'cumstances the master was not liable. He nonsuited the plaintiff, and allowed counsel' 6 fee £1 Is and costs 12s. .
