[ Plaintiff, in her evidence, stated : tl'Mfc she had iea-ged the land to d'efenda'nt iat a rental of £1 air. acre. The lease ran out ki. April, 1909. Neither | defendant nor his wife had complained !of tliie rent being too Bitgh. When ! the Jiease had expired witness had rej ce-ived a telegram from defendant rc- ! questing a renewal of .the lease on the_ sam-3 tennis ais formerly. PlUintiff liad iinformed defendant tha,t she would allow him £6 if he would repair the (fences. The fences had never beer, Witness had. received £5 from FP.Hcon in 1909, and no furthe-. pa.Vir.en.t was till April, 1911; - v.flien £ls was d-ue. Mrs Ellison had then ipaird plaintiff £5, and there was £lo' still due.
After cross-examining plaintiff, counsel for defendant said he would agree to judgment by consent for the fivl'l amount, with cost,s. £2.
