Mich-, ael Fitzgerald, the licensee, was char-J ged with exposing liquor for sale on | .the- wane occasion. Defendant said I >t.he four men 'in question came to his . hotel about 9 p.m. on Sunday, March ,17ith, and asked for drinks. He to- , plied that he .could not serve them, ibu't offered to "shout," and invited Ithean, to the bar, closing the door behind him. He opened the. door when the police knocked. There was no suggestion c-f any money being paid for the drinks, and he had no intention 'whatever of breaking the law. Mr N". OR. Russell, counsel for the defendant, isaid there v.\io an idea prevalent aimongst publicans that they could ehtertt&n- their Mcndis. on- .Sundays. Counsel quoted the ruling of Supreme Court Judges in a somewhat similar .case, whore decision had been given in tfa-vour of the licensee. The Magistrate (Mr L. G. Reid, S.M) reserved decision.
