CARTERTON.
In the Magistrat-e'ft Ocrart on Wed-1 uesday,. several young men were' fined ■5& and costs for cycling at night with-j out lights attached to their machines, . I At the Magistrate's Court on Wed-j ne®d»ay, reference was made to the Oalrterton by-law concerning the speed at which motor cars may travel through the Borough. At the previous slitting, Dr Trimble, appearing for Dr Archer Ho-skiug, charged with exceeding the epeed limit of eight miles an hour, raised the point that the'by-law was ultra vires, inasmuch as it did not disclose the statute upon which it was based, that it wae indefinite, and that the speed limit of eight miles an hour was ridiculous unless \some place where &uch a- speed might •be dangerous was get out. Dr Tramjble also urged other points, and His Wtor■ship was prepared to give judgment, but suggested that the Bbrough Council should be represented by its solicitor in connection with the points' raised against the by-law. On Wednesday, when. it was called on agiain, Mr T. 'E. MauiiselT, borough solicitor, appeared, and said it ava.s not intended, to maintain the validity of the bylaw, which had been passed before motor care caone into general use, and was about to be revised. He offered no objection to the present charge being dismissed. It was dismissed accordingly, as was also a similar case against another defendant. Mr Maunsell -said he : hoped such a course would not lead to motori&ts traveling with undue speed through he streets 'of the Be-rough, aisi there was a- statute under which they could be dealt with.
