The couple bad .been living together, and since Potter's committal he had married the woman, who, when called, declined to give evidence against her linsband His Honour upheld her objection, and there being no other evidence, a direction. was given to the jury to acquit the , prisoner, which was done. In the divorce ease, Sarah Orr v. Eric Orr, desertion, a decree nisi was granted.
