Before evidence was taketn Mr Lavery raised two nonsuit points (1) That- the Court bad no jurKsdsotiony a.s the statement of Q*'aim disclosed!.a partnership; (2) That the defendant 00-uildi not •in any event be saied <for wrongful 'd'avftiarge, buit for. breach, of contract. After henrimg arguments, the Magistrate upheld tihe first point. Mr Page admitted tttuat the defence was altogether unexpected, and asked for time to look into ■the Vms;-; granted.
