Tiie Supremo Court was engaged, to- , day in Ihoairing a oaso brought against the Wellington Loan Co., claiming the return of £l6 18s lid; and £2OO damages for false imprisonment and £2OO for malicious arrest and malicious abuse of process by defendant company. In his statement of claim, plaintiff set out that in July, 1904, he borrow- ! ed from the defendant company £22 4s, giving as security a. promissory note. Later (he borrowed a further £lO. A summons was issued against Meikle and a person who endorsed the promissory note, and judgment was given for £39 7s, including arrest. In December, 1910, plaintiff paid to the company £33 13s, in full settlement, according to the statement, and in February last he embarked at Wellington on (the Turakina with the intention of taking a business trip to j England. On that day he was served ' with a summons for £ls 14s lid, being interest on the promissory note. I The defehdiant Company, in an affidavit, asserted that plaintiff was about to leiave New Zealand with the intention of evading payment: As a result an order was made by the Magistrate, and plaintiff was arrested and removed from the Turakina in the custody of am officer of the Magistrate's Court. In order that ihe might proceed on his journey, plaintiff paid under protest £l6 18s lid. ( The present case was the outcome 1 of those proceedings. Defendant Company denied that £33 13s was paid or accepted in full settlement, but was on account. The Chief Justice, after hearing evidence, held that the receipt given did ' not discharge the interest, and that plaintiff could not succeed in the present proceedings. J A non-suit was granted. |
