CLAIM FOR DAMAGES

JUDGMENT FOR CLAIMANT,

In the Ma'terton Magistrate's Court yesterday. Mr L. G. Reid, S.M., delivered his reserved judgment in the case of Adams v. Percy, a claim for £l-1 for damage to a trap and harness owned by plaintiff. His Worship contended that contributory negligence on (the part of plaintiff, in tethering his horse to the fence of the paddock in which defendant's stallion was running, did not disentitle plaintiff to recover damages, but it would affect the amount of damages. He gave judg menit for plaintiff for £5 and costs £1 10b.

Mr C. A. Pownall appeared for the plaintiff, and D. K. Logan for defendant.

Mr Logan asked leave to appeal on a point of law, but his Worship stated that although he did not like to prevent an appeal, he did not think he should allow appeals in petty cases of this kind, where the question was one or fact and not one ,of law. He prom-i-ed, however, to consider the matter.
