LAND AGENTS' COMMISSION
A MAGISTERIAL DECISION. By Telegraph—Tress Association. HASTINGS, Last Night. A judgment,clearly defining when a land agent has earned his commission was given by Mr McCarthy, S.M., at the local Court this morning, in the case Cassidy (land agent) v. Masters, a claim for £25 commission on a sale of a property. The Magistrate said where an agent is instructed to sell a property at a certain price, and he procures a purchaser at that price whom the vendor accepts, and a binding contract for sale ds entered into between the vendor and purchaser, who signs a contract, then, in the absence of special terms of employment, or of misconduct or misrepresentation on the part of the agent, the latter is entitled to commission, even though the purchaser afterwards refuses to complete. Judgment was given for t/lie plaintiff for £25 and costs, £4 Bs.
