AN INTERESTING CASE.

WELLINGTON, Last Night. In the Court of Appeal to-day, the case of Lucena y. the National Mutual Life Association of Australia is being heard* 'The case raises some interesting questions as to the extent to which communications made by *a doctor to a patient, or to a doctor, in the course' of consultation, are privileged from disclosure ,in courts of law. The question' turns »on, the construction of section 8 (3) of the Evidence Act, 1908. : The defendants eompany tendered evidence, which wds objected to : by plaintiff, of information gained by observation during an examination, and later during an operation on plaintiff. Mr Tread well appeared for the defendant Company in support of the application to admit evidence, and "Mr W. H. D. Bell appears for plaintiff to object.
