CHARGE OF THEFT.
A CASE DISMISSED
At tho Masterton Magistrate's Court yesterday, before Messrs Eli Smith and J. Brown, J.P.'s, Frederick Butcher, on remand, was charged with having stolen a saddle, valued at 30s, the property of Leonard Compton, of Clareville. Butcher was remanded some weeks ago in order that lis might find one Williams, who, it wai alleged, had signed a receipt for I the sale of the saddle to defendant, Mr Cullen, who appeared for the accused, stated that a search had been made for Williams at Masterton, Gladstone. Taratahi, Belvedere, Carterton and other places, but no trace I of him could be found. ' The Bench stated that the Sergeant' had brought no evidence to show that accused's evidence was unreliable, nnd the Bench had either to believe him not guilty, or that he and his witness were committing perjury. The receipt produced was not satisfactory, bnt as accused's evidence had not been shaken he would bo given tho benefit of the doubt. Tho information was dismissed.
