THE NODINE CASE.
SETTLEMENT ARRIVED AT. NODINE RELEASED FROM PRISON. WELLINGTON, Last Night. Tbe tangle of lit'gation between James Alexander Hannah and Charles Nodine, which has occupied the attention of the Supreme Court on so many occasions during the last few months has at length come, to an end. In Court'this afternoon Mr A. Dunn, counsel for Mr Nodine, explained to His Honoxr Mr Justice Cooper that a settlement had been arrived at between the parties, and it was asked that his client be discharged from prison. A formal agreement had been drawn up, and he asked that it be filed with the Court, lhe claim for rent for £674 17s 4d in respect of the premises oV Lambton Quay and defendant's couffter' claim for damages would be withdrawn. The terms ot the settlement arrived at Ere as follows:—-(1) Nodine is to pay Hannah forthwith the sum of £125, the receipt of .which was acknowledged'; J2j[ iodine is to .consent'to the to Hannah of £lO6 lodged as security in the previous action, Hannah,v. Nodine, and Nodine is at his own cost and expense to do such other acts as may be necessary to entitle Hannah to receive the sum of *106; (3). In consideration of such payment?, the agreement and" lease concerned in the action shall be and is hereby surrendered, and the parties hereto mutually release each other from all actions, claims and demands, whether for rent, damages, breach of contract, or in any other respect which either may have or claim to have against the other in respecc of the said agreement for lease, or in anywise in relation thereto, or any legal proceeding between the parties; (4) Hannah to consent to the discharge of Nodine from the order of attachment issued against him. His Honour made an order in accordance with the terms of the agreement, and instructed, the Registrar to liberate the prisoner. Mr Nodine will consequently be re-r leased. He hss been in prison for about two months.
