A PONGAROA BANKRUPTCY.
.... o SUMMONS DISMISSED. Judgment was given by Mr Justice Chapman yesterday morning, in a matter in connection with the bankruptcy of Edwin Barker, of Pongaroa. The bankrupt had transferred his property, a farm, at a price much below the Government valuation to Albert Packer, a previous partner. The question the Official Assignee submitted was as to whether this transaction was' fraudulent. In his decision, his Honour declared that to prove fraud it would have to bo shown that some understanding existed between the parties amounting to a trust, or that Barker made a fraudulent sale at a price below the valuation to oblige his friend. Neither alternative had been proved. It was a case for suspicion and nothing more, and the suminons was dismissed without costs. At the hearing Mr Myers appeared for the Assignee, and Mr C. B. Morison for bankrupt.
